The EU Deforestation Regulation of 2023 including not only conversion of forests to agricultural use but also forest degradation lays down due diligence as well as other rules regarding placing and making available on the EU market as wellasexport from the Union of certain relevant products that contain or have been fed with or made using seven commodities, i.e. cattle, cocoa, coffee, oil palm, rubber, soya and wood.
This binding legal act aims at minimising the EU’s contribution to deforestation and forest degradation in order to reduce global deforestation and intends also to reduce the Union’s contribution to greenhouse gas emissions and global diversity loss. Relevant commodities and relevant products may only be im- or exported by operators or traderswhen three conditions are fulfilled: they are deforestation-free, have been produced in accordance with the relevant legislation of the country of production and are covered by a due diligence statement. The study focusses upon issues concerning the mixing as well as connecting not only European-wide but global aims related to (environmental) sustainability and climate (change) with instruments andmechanisms of international trade and economic law.Moreover, the interdependence between EU singlemarket and foreign (trade) policy will be discussed. A final important topic to be dealt with are rules as well as prohibitions which (general) international law is setting up for (EU) policiesmotivitated by presumptive global needs which are aiming atmodifications of economic, environmental and social policies of third States. Due diligence obligations for operators and traders to reach climate-related global and EU goals may be adequate instruments and procedures although they are set up unilaterally by importing countries (of the Global North), but establishing (bilateral) partnerships as well as concluding other intergovernmental agreements between producing/exporting States and importing/consuming nations might be a more adequate option. Value or supply chain management is guided by „soft law“ directives at global levelmainly today but fight against climate change seems to require more „hard“ rules for which the EU approach might be a step in the right direction.
