Different Actors, Different Factors – Science and Other Legitimate Factors in the EU and National Food Safety Regulation

According to the principle of risk analysis established by Regulation 178/2002, food safety measures in the EU and Member States must be based on scientific risk assessment. Apart from science, however, decision makers should take into account other legitimate factors, such as societal, ethical or traditional concerns. The extent to which risk managers can deviate from scientific evaluations in considering these factors depends on how much discretion is conferred on public authorities. This article compares the discretion at both national and Union levels of food safety regulation in the context of the internal market mechanism by analysing the standard review applied to food safety measures by the European judiciary.

Risk regulation interferes with market mechanisms to protect interests such as health and the environment. 1 Regulation in these fields relies heavily on technical expertise. Risk analysis is a methodology incorporating science into the decision making process, where risk managers take regulatory decisions based on the scientific risk assessment provided by experts. Clearly, science is not able to take responsibility for all decisions for society. Apart from scientific risk assessment, decision makers must also take into account different interests and concerns of social, economic or ethical character, including, e.g., consumer risk perception, animal welfare, and traditional methods of production. In the risk analysis methodology established by Regulation 178/2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (the so-called General Food Law, hereinafter also referred to as the GFL)2 these concerns, considered at the risk management stage, are recognized as “other legitimate factors”. Despite the growing controversy about whether and to what extent risk managers, by taking into account non-scientific factors, may decide against the findings of risk assessment, the role of these factors in EU food safety governance is not clearly formulated.

Waste poses a major problem area as well as a great business potential in countries throughout the globe. Therefore, cross-regional collaboration between leading companies, universities, and public authorities is not only necessary to overcome problems of environmental degradation and pollution; it is also good business for everyone. The Coolsweep project aims to support the development of these cross-regional partnerships by establishing research driven collaboration between leading European stakeholders within waste-to-energy. The project partners include five major European cleantech cluster organisations, two universities and one cluster analysis organisation deriving from Italy, Spain, Denmark, Austria, Norway, and Latvia.

The Financial Crisis in the European Union: An Impact Assessment and Response Critique

By the fall of 2008, no economy in the world was safe: the financial crisis was global and pervasive. Even the European Union, regarded as one of the largest and strongest economies in the world, was beginning to experience the severe effects of the financial crisis. At that point, the European legislators determined that some form of response to the crisis must be created. This paper will cover the landscape of the European economy before the financial crisis and the policy stances of the EU during that time, an overview of the complex financial crisis and its effect on the European economy, and a general outline of the policy response to the crisis.

The Impact of the EU’s Russia Sanctions on the Obligations under EU Chemicals Legislation

The EU’s sanctions adopted in the wake of the Russian invasion of Ukraine are in numerous ways unprecedented, especially considering the close economic ties that previously existed between the EU and Russia. The sanctions packages have therefore largely separated the two economies (as they intended to do) and thereby severely affected businesses and supply chains in and outside of Europe. While most multinationals are well aware of the impact on trade and have set up advanced compliance systems to ensure no prohibited trade in goods and provision of services takes place, there appears to be less awareness of the impact of the EU’s sanctions on operators’ compliance with EU chemical legislation. However, the sanctions also impact the obligations under the EU’s chemicals regulations, most notably on mandatory sharing of (vertebrate) animal studies but also related to the joint submission of registrations. This contribution hence examines the interplay between the respective obligations under the EU’s sanctions regime and the EU’s chemicals regulations, to allow operators to asses and determine their compliance strategies. While the contribution focuses on the interaction with the Russia sanctions, the same comments would apply generally to other sanctions imposed by the EU.
